Welcome. These Terms of Service ("Terms") govern your use of the website at qiklists2.com (the "Site") and the QikLists 2.0 waitlist. By using the Site or joining the waitlist, you agree to these Terms. If you don't agree, please don't use the Site.
The Site is operated by FKV LLC ("we," "us," "our"). Contact: quincy@qiklists.com.
The Site exists to describe QikLists 2.0, a forthcoming subscription product for Amazon online-arbitrage resellers. The Site itself is informational. It does not by itself give you access to lead lists, software, or any other deliverable. Access to the QikLists 2.0 product requires a separate paid subscription, governed by a separate subscriber agreement that will be presented to you at the time of signup.

Joining the waitlist is free and does not create any obligation on your part to purchase, or on our part to offer you access. We reserve the right to limit, prioritize, or close the waitlist at our discretion.

The Site, its design, text, graphics, logos, code, and the "QikLists" and "QikStack" names are owned by us or our licensors and are protected by copyright, trademark, and other intellectual-property laws. Nothing in these Terms grants you any license to use them, except the limited right to view the Site for personal, non-commercial purposes.
If you send us feedback, suggestions, or ideas about QikLists 2.0, we may use them without restriction or compensation to you.
The Site may link to third-party websites (for example, Amazon, Stripe, Acumbamail). We are not responsible for the content, policies, or practices of those sites. Visiting them is at your own risk and subject to their terms.
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
QikLists 2.0 will describe Amazon online-arbitrage lead opportunities. Reselling is a business activity with risk. Profit numbers, ROI projections, and category eligibility are estimates based on data available at the time and may change without notice. Past results do not guarantee future results. You are solely responsible for your purchasing, selling, tax, and compliance decisions. Nothing on the Site is investment, legal, tax, or accounting advice.
To the maximum extent permitted by law, FKV LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Site or the waitlist — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to the Site or the waitlist is limited to one hundred US dollars ($100).
Some jurisdictions do not allow certain limitations of liability. To the extent any limitation is unenforceable where you live, it will be enforced to the maximum extent permitted by applicable law and will not affect the validity of the remainder of these Terms.
You agree to defend, indemnify, and hold harmless FKV LLC from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site.
We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms; if we make material changes we will update the "Last updated" date and, where appropriate, notify waitlist subscribers by email. Continued use of the Site after a change constitutes acceptance of the updated Terms.
You can stop using the Site and unsubscribe from the waitlist at any time. We may remove your waitlist subscription, or restrict your access to the Site, if you violate these Terms or for any other reason at our discretion.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. You and we agree that the state and federal courts located in Alameda County, California have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Site, and you consent to personal jurisdiction in those courts.
One-year limitations period. Any cause of action or claim you may have arising out of or relating to these Terms or the Site must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
California residents — Civil Code §1542 waiver. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
For contractual purposes, you (a) consent to receive communications from us in electronic form via the email address you submit, and (b) agree that all Terms, agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. This consent does not affect any rights that are non-waivable under applicable law.
Email is not legal notice. Communications sent through our website forms, customer-support channels, or general inboxes do not constitute legal notice to FKV LLC or any of its officers, employees, agents, or representatives in any situation where notice is required by contract or by law. Legal notice must be sent by certified mail or recognized overnight courier to the mailing address listed at our Privacy Policy (Section 13, Contact) or to such other address as we may designate in writing.
